Is Kagan Qualified for Supreme Court Ruling on Obamacare?

On Monday, Obamacare finally went to the Supreme Court for a ruling on it being constitutional, but new evidence from Supreme Court Justice Elena Kagan leaves the question of whether she is qualified to aid in their ruling.

Certainly, before being nominated to the Supreme Court she was entitled to an opinion. But who would have ever known that Obamacare would need to be ruled on? Feel free to read that as sarcasm.

Look, these surfaced emails between Kagan and Harvard Law Prof. Laurence Tribe should be enough for her not to be included in the ruling. She shows that she is has a personal connection.

In one email, Kagan says to Tribe, “I hear the have the votes, Larry!! Simply amazing.”

Does this show favoritism? You bet. Does it mean that she cannot rule on the matter? This still remains unknown.

She obviously knows the law. But, can she follow the law when it comes to deciding whether or not Obamacare is constitutional or not?
