North Carolina Considering Bill to Ban Sharia

RALEIGH — A group of Republican legislators is backing a measure that would make it illegal for judges to consider “foreign law” when making rulings in North Carolina’s courts.

Though the federal and state constitutions already guarantee the supremacy of U.S. law in domestic cases, primary sponsor Rep. George Cleveland said he is concerned that Shariah law could gain a foothold in American communities with sizable Muslim populations.

House Bill 640 makes no mention of the Islamic legal code. But Cleveland said Shariah would be defined as a “foreign law” under his bill, and therefore banned from North Carolina’s courtrooms if the legislation he proposes is approved.

“It’s to ensure that any individual in this state does not have to worry about being taken advantage of by foreign laws,” said Cleveland, a retired Marine who lives in Jacksonville. “It’s barring any international law. If Shariah law tries to be enforced in the state, yeah, it would do it.”

Missouri House Bill Prohibits Sharia Law

On Wednesday, the Missouri House approved a bill that prohibits courts to use or recognize Sharia law.

STLToday | A bill prohibiting state courts from using or recognizing Sharia law passed the Missouri House Wednesday on a 102-51 vote. 

The legislation, which was sponsored by state Rep. Paul Curtman, R-Pacific, bans Missouri courts from utilizing foreign law or legal code in any ruling. Although it never specifically mentions the words “Sharia” or “Islam,” Wednesday’s debate focused almost exclusively on Sharia law, which is the religious law of Islam. 

“This bill is not all about Sharia Law,” Curtman said. “It’s Sharia Law, French law, Dutch law or anything else.”

Islamic Law: A Look From the Inside

There have been many who have offered a look into Islamic Law, more commonly refered to as Sharia, but Andrew Bostom at American Thinker helps shine a brighter light. His digging deeper into Bill O’Reilly and guest Wafa Sultan is a great piece and well worth looking at.

Last night for a few brief shining television moments (captured here), Wafa Sultan, courageous  author of the indispensible jeremiad “A God Who Hates,” strove gamely to educate Bill O’Reilly — often seemingly impenetrable

The news “hook” for Wafa’s unfortunately rare appearance was the recent alleged rape of a Libyan woman, Iman Al-Obeidi by Qadaffi’s minions.

Oklahoma Sharia Ban in Court

A federal court judge is slated to hear arguments today on an injunction blocking Oklahoma’s new constitutional amendment prohibiting the use of foreign systems of law in reaching legal decisions.

On November 2, Oklahoma voters passed a ballot initiative banning the use of Sharia and international law in Oklahoma courts by a whopping 70%. The new law explicitly reaffirms the supremacy of the federal and the Oklahoma state constitutions. 

Just days after the vote, Muneer Awad, a member of the Council on American-Islamic Relations (CAIR), filed suit to block the law’s implementation, claiming that it violated his constitutional rights.

Court order blocks Okla. amendment on Islamic law

A federal judge issued a temporary restraining order Monday to block a new amendment to the Oklahoma Constitution that would prohibit state courts from considering international or Islamic law when deciding cases.

U.S. District Judge Vicki Miles-LaGrange handed down the order after an Oklahoma man filed a lawsuit claiming the amendment stigmatized his religion and would invalidate his will, which he said is partially based on Islamic Law, also known as Sharia Law.

“My constitutional rights are being violated through the condemnation of my faith,” said Muneer Awad, executive director of the Council on American-Islamic Relations in Oklahoma. “Islam was the target of this amendment. This amendment does not have a secular purpose.”

The measure, State Question 755, was approved with 70 percent of the vote in the Nov. 2 general election. The judge’s order prevents the state Election Board from certifying the results of that vote, which it had planned to do Tuesday afternoon.

The order will remain in effect until a Nov. 22 hearing on a preliminary injunction.

Oklahoma Bans Sharia Law

Voters have passed an amendment to the Oklahoma state constitution to ban the use of Islamic Sharia law in the state courts by an overwhelming 70% of the vote.  The amendment also bars judges from using foreign law in rendering decisions.

Seen as a pre-emptive strike, Oklahoma now joins Louisiana in blocking Sharia law, a draconian legal doctrine that does not recognize the most basic human rights as measured by any Western standard.

As previously reported on HUMAN EVENTS, free speech rights are under assault worldwide through violence, threats of violence, and Sharia-compliant “incitement” laws.
